Colorado Supreme Court Strikes Down CU Gun Ban
The Terry Ryan Law Firm is proud to have represented Rocky Mountain Gun Owners in filing an amicus brief in the case of University of Colorado Board of Regents v. Students for Concealed Carry on Campus (Case No. 10SC344), which came before the Colorado Supreme Court last year. Oral arguments in this case were held June 8, 2011, and the Court's decision was issued March 5, 2012.
The question before the Court was whether it was the intent of the Colorado Legislature, at the time it passed Colorado's Concealed Carry Act (CCA), that the CCA would divest CU's Board of Regents of authority to ban concealed handguns on campus. The Court held that this was the legislative intent:
We hold that the CCA’s comprehensive statewide purpose, broad language, and narrow exclusions show that the General Assembly intended to divest the Board of Regents of its authority to regulate concealed handgun possession on campus...
The CCA achieved its intent to bring about “statewide uniform standards” through its substantive provisions. Twice the CCA expressly states that, except as limited by the CCA itself, a permit to carry a concealed handgun authorizes the permittee to carry a concealed handgun “in all areas of the state.”
This is a big win for our right to keep and bear arms, for Second Amendment lovers in Colorado, for Concealed Carry Permit Holders in Colorado, for students, faculty, administrators, vendors and anyone else who has occasion to spend time on the campus of the University of Colorado or at University Hospital in Denver. University Hospital is also governed by the CU Board of Regents, and this Firm has a client who, heretofore, was forced to give up his rights under Colorado's CCA in order to obtain medical treatments at the hospital. The Courts ruling will favorably impact our client, who is also a veteran and retired law enforcement officer.
This decision preserves the rights of Concealed Carry Permit holders in Colorado, preventing the infringement of those rights in the form of "patchwork law" that is inconsistent across the state.
